EMPLOYEE LOYALTY IN RELATION TO THE WHISTLEBLOWER DIRECTIVE

The whistleblower protection directive may have a significant impact on the essence of understanding employee loyalty in employment relationships. In this paper I argue that possibility whistleblowing does not contradict duties as expressed Article 100 § 2 section 4 Labor Code. my opinion, thesis should be put forward employee’s duty is limited to employer’s lawful actions. It would unacceptable state relationship restricts freedom speech sense it prohibits from opposing unlawful conduct. Moreover, view, interpreted such way horizontal nature. This because refers business relations between market entities. doctrine and judicature extensively describe breaches by employees context relationships, relating other players, particularly those engaged competitive activity (the unit-unit relationship). contrast, provisions Directive whistleblowers are vertical standards, individual (public interest). Thus, employer cannot outweigh acting public interest, which emanated Directive.
